Not quite. Cellular telephones are specifically protected by both radio 
regulations and more directly by a specific section of the criminal code 
regarding "private communications".

While it is certainly possible to listen, and hundreds of people do, and it 
is seldom enforced it is illegal and in the unlikely event that a complaint 
were filed and acted on, the penalties, since they are in the criminal 
code, can be severe.

Besides, I should hope that someone who can afford an FT90 (and hopefully 
has a licence) would have better things to do with their time than listen 
to other people's phone conversations.

Just my 2 cents worth.
