The rule they will tell you is that you have to turn all electronics off, for example cell phones and i-pods etc during take off and landing. Plus you can't have cell phones on at all.
Well I have the blackberry nextel and I never turned it off during the flight. I didn't have cell service but I could use all the other functions. I also brought my scanner in my bag. I used it with low profile headphones, the ones from my i-pod and left the unit in my bag when I was using it and did so with no problem. For instance if I was scanning the aircraft band I just used it while it was in my bag on my lap so I could see the display and didn't have any issues.
For me I look at it like don't ask, don't tell policy. If they had asked me to turn it off I would have so it's not like I asked, they said no, and I did it anyway. Since people can listen to walkmans on there that have radio listening devices built in, I don't see the issue.
