Michael:

I think you'll find the policy varies by airline and, of course, the Captain 
always has the final day.  I know if you look in the back of Delta's 
in-flight magazine you'll find that radio receivers, such as scanners, ARE 
permitted on their flights except during takeoff and landing.

Take a look in the back of the magazines where they list "information" and 
you're likely to find the policy, which you can point to if you're 
questioned about it.
