I am amazed that this topic keeps coming up, again and again. Licensed
amateurs are allowed to modify their radios to transmit on ANY frequency
(except perhaps cellular, I am not familiar with those rules.) The
illegality, for licensed hams, would be in the use on an unauthorized
frequency. How do you think 99% of the operators got their rigs to work on
60 meters?
