You are missing the point.
Just because you assume everyone is doing it doesn't make it OK.
If you get caught be prepared to take the consequences.
What radio was manufactured that came from the factory and could transmit 
(other than illegal non-type certified radios for the CB market) in 
unauthorized frequencies?
I believe your HT & base station had been modified to transmit on those 
frequencies and did not come from the factory in that condition.
