I'm not sure which staffer you're referring to, but the bottom line is a
staffer that works with the City Council HAS taken care of us. That
exemption language was included in a discussion and a meeting between
KH7U, KH6MEI and AH6RH with the Transportation/Planning Committee Chair
person, and the result of that meeting has gone through the process and
has led up to being included in the official version coming out of the
second Transportation/Planning Committee meeting, which is heading to
the Council's Third Reading.
1) That exemption language has been entered and passed the
Transportation/Planning Committee as Bill 4, CD2 FD1, Okino's version,
as it exempts both two-way mobile radio used in the scope and
fulfillment of work-related duties, and amateur radio. So we want to
testify that we support this version.
2) Apo's version replaces the text of the infraction with holding the
mobile electronic device near the ear. Normally, this would exclude a
handheld two-way radio microphone, but for the interest of clarity,
we're asking for a clear exemption so that both the two-way radio users
at work and amateur radio users would be covered. So we want to testify
that we support Apo's version with a clear exemption for two-way and
amateur radio. It's likely that Apo's version might not be considered
in the full Council -- but really, anything can happen. Someone could
walk in a third version on Wednesday morning.
3) At this time, there is no CD3 version -- either proposed or passed.
It would appear as CD2, FD and a number.
None of this is effective and a done deal until we see what happens at
Third Reading. That's why we want to communicate our support for these
versions of Bill 4, as described above.
