There is one simple answer.

The Local FSDO, and the FAA are going to to do the "final" blessing.  
Therefore, you are going to have to follow what THEY "claim".

This is a losing battle.  The FCC "may" claim one thing, BUT the FAA 
rules in cases of aviation.  The NDB certification is wholly under the 
purview of the FAA.

Best of luck in trying to get the FCC to hold "power" over the FAA.
