Congress could enact,  and POTUS sign, legislation prohibiting BPL any time
they so desire.  The FCC, being created by an Act of Congress, has only has
the power that statutes give it.  Even if it didnt choose to enact
legislation prohibiting BPL members of Congress, being the body that in part
confirms FCC Commissioners and wholly enacts its budget, have much more pull
than the average system.  And a Commissioner is more likely to pay personal
attention to letters from members of Congress than those of private persons.
