Cellular telephone interception is definitely
prohibited by FCC regulations in the United States no
matter what. Only those persons who are legitimately
servicing equipment, making range checks, etc., can
legally listen in and they cannot tell anyone anything
that they hear. That is why those frequencies are
"locked out" of all scanners sold in the United
States.
I do know that people modify equipment to be able to
listen. However, they are definitely liable for fines
up to $10,000 per day if they are caught.
