neither of the above. he could not prove that he did not make the
purchases. the purchases were for common everyday expenses. fill-ups od
gasoline at the local road ranger, groceries at the grocery stores, hair
cuts at the local hair style place. none of the places where purchases
were made had a video record of the transactions. even though my friend
had many friends testify that he has never had even a debt card that he
paid with a personal check or cash the court ruled in the bank's favor.
he never knew something was up because there were no goods ordered that
needed to be delivered. his lawyer filed an appeal and even there the
appeals court sided with the lower court. by the time he became aware of
the problem there was all ready several thousands of dollars charged to
the credit cards. it all boiled down to not being able to prove that he
did not purchase the services or goods. the low life was not going to
testify that he committed the fraud and made the purchases. it is a sad
situation when the victim is victimized again in the courts.
