I'm sure that if you work with the retailer you could get them to exchange a 
near new tool and then they work with DeWalt on the back side. The last 
thing they want is to get a bad rep among the tradesmen. My son-in-law is a 
contractor and is always taking stuff back to Menards, they always take it. 
I don't know if Menards eats the loss because he is a high volume customer 
or they have the pull to get replacements from the manufacturer because of 
their size.

That may be DeWalt's policy, but it won't fly in some states.  Check
your state's laws.

Many states have an "implicit warranty" provision, that basically says
that if you purchase an item sold to do a job, it should be able to do
that job.  If the screwdriver shank spins in the handle so it can't
turn screws, that's a violation of implicit warranty.

If in doubt, assume the manufacturer or retailer will work to make
things right, and seek a fix.
