I have a suspicion that connections make a BIG difference.
I just attended a wedding reception in a newer hotel.
This hotel had an atrium with four stories of balconies surrounding it.

  3-Pipe rails, nothing but ladder effect spacing about 12 inches.

I had to leave the room.
Watching the kiddies,up several flights standing on the middle rail 
waving to their sybs accross the abyss, made me nervous.

I am no code junkie, but some money just had to change hands for them to 
get past the inspection.
