I would think that it depended on whether or not the design was sold as 
part of the business or if Tom maintained ownership of the design.  Not 
knowing all the details, but based on what I've read I think Tom would be 
free to do as he wishes with the design.  He may have to rename the hammer, 
but the copyright should still be his since it predated the establishment 
of the business.

Now we all await the next installment from Andy.  Maybe he'll break out of 
his hermit like shell and tell us what he really thinks of the 
situation.  <big grin, ROFLMAO)
