i sent a "smoking" e mail to arrl, still waiting for a reply, but not gonna
hold my breath. FCC is next to get some mail from me, please do the same.
as Robert states below,experimental operations are covered in CFR47:
5.67 Policy governing the assignment of frequencies:
"Frequency assignments will be made only on the condition that harmful
interference will not be caused to any station ..."
it is clear that if they are causing interference, then they must cease
operations.
