I rest my case. the prior authority and ham license make it legal a legal
transceiver.
Please review both federal and state statutes on this subject.
I see and hear a lot of even law enforcement who use ham or marine
transceivers for other than their prescribed use-without any license. This
by statute is illegal.
Proud of you for obtaining the proper documentation.

This Motorola GP300 I'm holding in my hand is capable of transmitting on
both public safety and ham bands if programmed to do so. If the
programmable buttons are setup for memory bank switching you can even
isolate the two bands so they aren't confused. I don't think anyone
would argue that its an illegal radio in any way. As far as I'm aware
it would be perfectly legal to use it that way so long as the operator
has both a ham license and proper authority to use any public safety
frequencies programmed into the radio. It is not legal to operate a
modified ham radio on the public safety bands, however. (It is
perfectly legal to operate a modified ham radio on some non-ham bands,
of course.)
