Andrew, regarding an HOA agreement, I am sure it will have a section 
pertaining solely to prohibiting any two way radio operation including 
CB and amateur radio operation, no external tower or internal antenna 
operation, etc., If the HOA applicant is an amateur radio operator and 
signs the HOA agreement, he/she waves his/her federal law legal 
protection coverage and then must abide by that applicable section in 
the HOA agreement.

If not an HOA controlled area and an external tower is in use, typically 
the county or city antenna height restrictions apply.
