A very interesting statement indeed.  Those who have talked to the average
lay person concerning scanner listening (PD & FD members who are not
hobbyists included) knows that this can mean MANY things, and not
necessarily "encryption".  I have heard fellow police officers refer to
simplex, trunked, and even different frequency bands as "private" or
"unmonitorable".
