[Scan-DC] Delaware vs. Maryland Frequency Grab -update anyone?

All,
The article in my previous post mentions frequency
availibilty.  Reading through the different stories,
it looks like Maryland is in one FCC region and
Delaware is in another.  
It looks like back in 1999, Maryland requested 35, 800
MHz frequencies but only needed 28.   Maryland
"returned" the unused frequencies to the FCC. 
Delaware requested to use those frequencies from the
FCC, but the FCC ruled against Delaware stating each
region had an equal amount of frequencies.  If
Delaware used Maryland's "unused" frequencies, then
Delaware's region would have more frequencies.
Delaware used them anyway and the State of Maryland
filed an injunction against the State of Delaware.

Does anyone know how that issue resolved itself?
