Well,

True, you could sit on the perimeter of the base and monitor whatever you
like. 

I look at it as more of a public interpretation issue. A lot of people I
would think would be curious of someone listening to a radio device and not
in uniform on a military base. Some people don't even know what a scanner
is, let alone you can go to Radio Shack and buy one for $200 and listen away
to pretty much everything (the old days.).These  same people even think
cordless telephones are 'secure'.

So public perception may play a part. All these 'people' listening to
scanners...could by terrorist plotting something.. in there mind.

I could remember several years ago when I had my first digital camera. I got
bombarded by people stopping "what's that?" "how's that work?"

I could see the same thing happening, just these people running to the MPs
and saying, "Hey, that dude with the cameras are listening to the pilots and
noting frequencies, better check him out!"
