Mike and group,

        I agree with what you are saying....there are two sides to every
story!

I don't think there has been a crucifiction here.

I see quite a few items offered for sale on the lists and on the auction
sites with the statement that

"All damage claims to be settled between the buyer and the shipping
company".

That does not make the shipping company responsible to the buyer....it only
attempts to relieve the shipper of any responsibility to the customer in the
event of shipping damage.  Most shipping companies will not give the buyer
the time of day during one of these events beyond allowing the inspector to
see the package in question and maybe doing some of the paper work.  Any
money that changes hands during claims settelment will be between the
shipper and the shipping company...not the buyer.  That is not likely to
happen unless the seller pursues the claim....

So I guess "Buyer Beware" is in order if you are dealing with someone that
doesn't want to accept the responsibility that the shipping company's place
upon them!
