The point is that you should still get a release for export or face the risk
of jail / fines. Silly yes, but becoming a felon is not!

The owner has a choice, comply or face the risk:

NOTE: Export of this product is subject to U.S. export control laws. Export
Licenses are approved on a case-by-case basis and sale of any of these
products is dependent on approval of the United States Government.

You should know that violation is a felony, and not a misdemeanor. The
penalty is rather stiff. Not a big deal unless your the guy they decide to
prosecute and make an example.
