Regarding the message you forwarded, I don't think the ARRL understands
what the ARPA is meant to do either.
BTW, I called both Senators Bennett's and Gardner's offices on the phone
yesterday, and asked for their support in passing the measure.
Anyway, here's my brief email exchange with ARRL -- don't think they
have a clue -- and their no help at all (why don't they find the answer
instead of referring me to someone else):

There are several things in play here, so I would recommend you contact
one of the ARRL Volunteer Counsels in Colorado with your query. I am
not an attorney and can't offer legal advice on the issue of
enforceability of the covenants since an HOA was never formed. Go to
*arrl.org/locate-a-vc* where you will find a searchable database.
Select Colorado and search. The VCs are attorneys who are also amateurs
and have agreed to do an initial consultation with amateurs on things
like your question.
When the Parity Act passes if would apply to any current or future HOAs
within the parameters of the law as the FCC write the specific language
into the rules.

I have a question about how the Amateur Radio Parity Act will affect me
if it passes.
Our residential area has covenants forbidding antennas (or "antennae",
as they call 'em), but we have no HOA or enforcement agency. We were
supposed to form an HOA within so many years after the builder starting
building homes, but I guess everyone was too lazy.
But the covenants are still in force. There are many areas which have
covenants, but no HOA.
