Not sure if I'm doing this correctly but wanted to pass on this information.
The Transportation and Energy Committee of the Colorado House of
Representatives recently heard testimony on HB 09-1094, a bill concerning
Wireless Telephone Prohibitions for Drivers. Colorado Section Public
Information Coordinator Robert Wareham and I attended the hearing and
testified on behalf of the Colorado Amateur Radio community. Prior to the
hearings, I had communicated with the bill's sponsor who assured me that the
legislation was not intended to restrict Amateur Radio mobile operation.
Nevertheless, there were still concerns. Mr. Wareham contacted committee
member Rep. Frank McNulty (R-Douglas) who agreed to offer an amendment
exempting licensed Amateur Radio operation. The amendment was approved by
the committee and the bill was reported favorably. It moves on to the next
step of review by the House Appropriations Committee then a vote by the full
house. While we can't predict the future of the bill, the language
exempting Amateur Radio operations from vehicles is now part of this pending
legislation. It is unlikely that this language would be removed should the
bill pass the Senate and ultimately be approved by Governor Ritter. If
approved, the bill has a target 'in effect' date of December 1, 2009.
