Indeed you can, however the original posting mentioned

My point was that this would not be a good time to violating this
particular rule, and letting the news media "advertise" the fact.

On the other hand, it's an excellent time to SWL mil freqs (the lower
end of 11.175 USB usually has quite a number)!
