In Nov 2007 the Internet Tax Moritorium was extended 7 years. This act exemted internet sales from being subject to tax accross State lines. If you buy from a internet site in your own state your still subject to tax. So no sales tax on out of state transactions untill Nov 2014.

E-bay's take on the 1099 issue is they do not feel they are subject to issue them as they view themselfs as a venue enabling private parties to complete a transaction. They also state that they do not track the completeion of transactions, wether a item is actualy paid for and thus can not issue an acurate 1099.
