ISM bands under Part 18 are not automatically available for Part 15-type 
operation.  In fact, since March of 2009, 6765-7000 kHz has been allocated 
to fixed and mobile radio services on a primary basis.  It seems highly 
unlikely the FCC would look kindly upon high power "hifer" operation there 
nowadays.  Canada allows unlicensed low power devices in that slot, but I'm 
afraid it is a missed opportunity in the States.

(For that matter, not all bands covered by Part 15 itself are available for 
low power communication, either.  Some of them have very specific purposes 
and limitations, and/or stringent certification requirements.)

The "footnote 524" mentioned in connection with the allocation table 
suggests there is some outdated text in the version of Part 18 you are 
consulting, Kurt.  All footnotes in Part 2 now use "5." as a prefix for 
international (ITU) footnotes, plus "US," "G," and "NG" as prefixes for 
domestic footnotes.
