One other thing, just to keep in mind. I've actually been engineering product 
manager for devices that operate under FCC Part 15. I can tell you that I've 
had law firms that specialize in FCC stuff give me different interpretations 
on different parts of it. I've also had engineering firms who did testing for 
me (and did considerable work with FCC certifications) have different 
interpretations.

So the bottom line is you're unlikely to get a consensus answer--even if you 
hired a team of "experts". I know that as product manager, I've been the one 
who ultimately had to decide which "expert opinion" seemed to be a fair and 
reasonable interpretation of the regulations yet gave me the most flexibility 
in designing the product.

Over the years I'd guess I've been responsible for several hundred thousand 
dollars of legal advice, engineering advice, and device testing and 
certification services.

I don't say any of that to brag or to say I know the regulations better than 
someone else. I just say it so it's clear that even people who live and 
breath Part 15 as part of their jobs tend to have diverse opinions.

I have never seen the FCC do anything nasty to someone (whether an individual 
or a company) who made a "reasonable" assumption and ran with it. They might 
challenge that assumption at some point or flat out say it's wrong (and you 
go back to the drawing board). But as long as you really don't try to play 
games they tend give you some leeway.

(And playing games is something like selling "ham radios" that cover 10 & 12 
meters and, oh by the way, can also cover 11 meters but the instructions say 
don't do that. They can and have nailed people and nailed them hard for 
things like that.)

I will also say that I've asked different people at the FCC questions about 
Part 15 and received different answers. And I've had the FCC question me and 
had to explain why I interpreted the regulations the way I did. Although I'll 
admit that usually those responses were typically prepared by our attorneys 
with me having input. :-)
