I don't know much about FDA. But for laser communications isn't beam
escape
from your home? At this power (10W) laser beam may cause eye damage (or 
temporary blinding) of any pilots in airplane which fly around place
where
you experimenting with laser communications. I have homebuilt nitrogen
and
dye laser, and this beams newer escape my room. But, what if I will one
days
try making experiment outside my home? Here in Croatia I don't hear
about any
law that forbid this. But I as scientist and radio-amateur know that
somebody
may be accidentally close to place where I direct laser beam, and must 
thinking about this and must be carefully.
