The Kentucky legislature has a long record of passing bills that make
absolutely no sense "as written" and leaving it to the assorted police
departments across the commonwealth to decide how to try to apply it.
Keep in mind that at least one licensed Kentucky ham has already been
arrested under KRS 432.570 for possession of an unmodified radioshack 2m
HT -- despite licensed amateur radio operators being specifically exempted
in the law and despite the fact that the radio does not fall under KRS
432.570. Not only was the ham arrested for this "violation" but the county
went ahead with araignment and court did NOT throw out the case even when
both the exemption and the facts about the radio's frequency coverage were
demonstrated in court.
Do not rely on either the good sense of the Kentucky legislature or the good
faith of our police and prosecutors.

As written this bill would make use of most VHF/UHF
business radio illegal without a headset or other
hands free device. All these cement trucks, taxicabs,
etc. would cost thousands to outfit. The bill is sure
to be either passed with changes to exempt them (and
us) or be left to die. If on an odd chance it does
pass as written, 99 percent of police will likely fail
to enforce it as a primary offense.
