[Kenwood] TS850 freq. Transmit changes for marine use

I have a Radio Shack HTX-420 duel band HT that is type accepted. On the back it has the standard FCC type acceptance rederick. It does not specify that it is TA for the ham band only just has the legal stuff that it complies with FCC- yada yada yada. On page 9 I believe of the owners manual tells the operator how to do a soft mod to open up the MARS/CAP band, this also opens up the FRS/GMRS, UHF commercial band. This was not hidden by the manufacturer and plainly spelled out in the manual. Since this fact obviously made it past the FCC does that mean I can operate it out of band? I think that if someone were to operate out of band with this HT and get caught, a half way decent lawyer would be able to eat the FCC for lunch. It is not the operators fault the FCC type accepted the radio without doing their homework. And any way the FCC does not type accept radios anymore in the traditional sense. They no longet get a radio from the manufacturer and test it and toss it through a hoop or two like the used to. They accept it based on the manufactutrers spec sheet alone. I can see where alot of things like the HTX-420 will be getting through the cracks.
