Yes, Bill, it is.  However, BPL is, theoretically, required to operate without causing
interference, and to accept any interference it encounters.  We, on the other hand,
can operate HF at whatever level accomplishes our intended communications and, even
at less than full legal power, BPL's data rate will degrade in the presence of our HF 
transmissions.  Therefore, we're not causing intentional interference.  If we need
to run full legal power to overcome QRM and QRN, we're not doing anything illegal,
immoral or fattening.  :)
