I don't know about Canada, but south of the border here, the amateur would
be held harmless if his/her station was operating within the legal limits
of frequency, power, etc.  There have been many cases where cable TV companies
have complained about interference from hams, only to find that they had
one or more faulty connectors in their coax cable.  The hams got off scott free.
On the other hand, faulty cable TV connectors have interfered with ham stuff,
including keying up repeaters.  Our FCC ordered the cable companies to fix their
gear or shut it down.

I suspect us hams will win here in the States, as long as our gear is operating 
legally.  Hmmm...now where did I put my full legal power HF amplifier?
