There's still a legal problem with this.  I illustrate by example:

Pseudofedrine hydrocloride (Sudafed decongestants) are legal "over the
counter" drugs.  They're also the primary ingredient in methamphetamine
(speed -  a common "illicit" drug).

It's not illegal to possess or purchase Sudafed.  It is however, illegal to
knowingly sell them (typically in large quantities) to someone you know will
be using them to make meth.  Store clerks and owners have been prosecuted
for doing so.  (I know, because I was on the Federal Grand Jury that
indicted them).

The parallel here is that (1) you KNOW he intends to transmit out of his
authorized bands, and (2) if you sell to him and try to set him up, then (a)
it might be entrapment, and (b) he might not call YOU, but he may call
someone else.  If you don't catch him (more specifically if the FCC doesn't
catch him), but he does ultimately transmit without a license and/or out of
band (or over power on the CB band), then you HAVE aided him in the
commission of a crime, and to make matters worse, you've done so KNOWINGLY.

Now, if he hadn't said anything about CB or 26MHz or whatever, then you
could claim ignorance, and since we aren't talking 10,000 Sudafed tablets,
the FCC would probably believe you.  But since he did....
