If you have been keeping up with the BPL issue, you won't be at all 
surprised to hear that the FCC will probably be taken to the US Court of 
Appeals.  The ARRL (et al) have filed petitions.  For more details, see the 
article on the ARRL website www.arrl.org.  It's not the first time that the 
FCC has been taken before the bar for breaking its own rules.  It seems like 
every 20 years or so, the Justice Department has to take the FCC out to the 
judical woodshed.

To paraphrase a famous Cuban band leader: "Miiikkkeee, you got some 
'splainin' to do!"
