AT the time the 746 was designed and FCC approval given , 60 meters was not
a ham band. Icom there fore can not change the design on that radio for its
customers with out voiding that FCC approval....

As of just a few days ago:

""told by ICOM if I had a MARS license and sent them a copy, they would
supply the information on how to make the tuner function." - indicating that
Icom accepted and supplied modifications allowing the radio to function
within or near licensed amateur bands including 60m does meet FCC type
acceptance requirements for that model"

There is a mod and icom claims to supply it themselves, even for 60m
operation. Their only "requirement" is that a licensed Ham also be a MARS
operator, no mention of using the radio on current Ham bands or even mention
that it would exceed emissions standards and therefore it could NOT be
operated out of it's original design specification legally, only that the
information to operate the radio on 60m would be provided by proving proof
of something not required for hams in general or the 60m operation
originally asked about.

Operation out of band is of no concern to them as anyone can modify most
anything to do most anything they want regardless of original intent or
law(s) and those operators would rarely, if ever, contact a manufacturer for
tech support in known illegal operations.

Interestingly, it is also not required that the owner of the radio be a ham,
or even licensed, though we would assume he is since he asked about a ham
band mod and can also safely assume intends to transmit within the
limitations of his license. No apparent interest on icoms part there,
either, as they say they can provide the modification, so ultimate end-use
is a non-issue.

My interest is with icom's BS and far too typical non-answer that did not
address the users concerns and fabricated requirements.
