Your comments are correct - I was reading through RIC-2 and RIC-3 only
yesterday evening!
The rule prohibiting possession of unauthorised radio apparatus exists in
Britain and Canada, but not in the US. The Canadian Radiocommunication Act
states: "4. (1) No person shall, except under and in accordance with a radio
authorization, install, operate or possess radio apparatus..." There are
other exceptions for broadcast receivers and exempt categories such as
wireless LAN's etc. A Canadian ham who "opens up" his HF rig is technically
in breach, although Industry Canada will normally not institute enforcement
action unless the guy does something really stupid, such as transmitting on
a military or civil-aviation frequency.
The rule barring holders of the Basic licence from building or repairing
transmitting equipment is a subset of the above. For those hams interested
in homebrewing and experimentation, it is a powerful incentive to upgrade!
