...actually it not inconsistency. They just count on our ability yo self
police what we do and not do illegal things. For the most part the CB'er
doesn't invest much thought to the concequences of his operation. 
	it should just rise our self respect that such an institution as the
FCC is willing to allow us the leeway, and considers us the good guys. LET"S
NOT SPOIL THAT  !!!!

It depends on the context.  A CB'er (non-Amateur) who simply possesses the 
ability to transmit more than 5 watts on CB frequencies is considered 
guilty.  An Amateur who posses the ability to transmit on non-amateur 
frequencies is not.

The one consistency in the FCC rules is their inconsistency.
