It depends on the context.  A CB'er (non-Amateur) who simply possesses the 
ability to transmit more than 5 watts on CB frequencies is considered 
guilty.  An Amateur who posses the ability to transmit on non-amateur 
frequencies is not.

The one consistency in the FCC rules is their inconsistency.
