Just a thought here... perhaps we need to get "government agencies" involved, such as C&C DEM and State CD.  If we can get them to go to bat for the hams, we have a much better chance of getting things going.  That is, if they could "suggest" that if they include ham radio in the "banned" category, it could piss off the hams enough that they won't assist anymore during times of emergencies. (Obviously, most of us won't do that, but sometimes a little "push" is needed to show politicians how important it is to keep voluntary help happy.)  Having these agencies testify on how important ham radio is in times of emergencies could be the incentive for them to keep us happy by allowing us to use our radios in times of non-emergencies.  No different than the police using their radios in non-emergencies (like asking another officer where they want to meet to eat, etc.) I think that testimonies from  these agencies along with the amateur groups will probably
 be more effective than our individual comments.

Good point.  There's two way that Ham radio could be banned:



As a telephone: ""Mobile telephone" means a cellular, analog,

satellite, wireless, or digital telephone capable of sending or

receiving telephone messages without an access line for service."



Depending on how a judge defines "telephone messages", that could be a

two-way radio as we easily meet all the other criteria.



As a electronic device: ""Electronic device" means handheld electronic

video games, music players, personal digital assistants, or any other

device requiring the use of a battery and at least one hand to operate

the device."



Again this depends on how  "use of a battery" gets defined.  Does it

include the car's electrical system?



Note that the exemption for "Commercial vehicle means a vehicle

registered to a business that has a gross vehicle weight rating of ten

thousand and one pounds or more." is going to make for a lot of

unhappy taxi drivers.  If there's a way we can piggy back on that, I
