The determination of "fair use" is set forth in the 
U.S. Copyright Statute (found in Title 17 of the United States Code.  The main issues can be summarized in four factors:

1.  the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes; 

2.  the nature of the copyrighted work; 

3.  the amount and substantiality of the portion used in relation to the copyrighted work as a whole;

4.  the effect of the use upon the potential market for or value of the copyrighted work. 

One can test the proposed use of published material on these four factors and see how the balance tips with each answer. 
Then decide for yourself if the balance tips in favor of fair use or in favor of getting permission.
