[Ham-Computers] Another Wi-fi question

I believe particular channels fall within the amateur band (2.4GHz), and it
could be "hopped up" as long as you have your call for the SSID. I have
seen/heard this discussed.
As far as DX'ing for access points, I recall a story sometime back from
Michigan. I fella spent his lunch break parked outside a coffee shop with
his laptop. A waitress was suspicious after he did this for several days,
and thought maybe he was scoping someone or something out. Seems he was
prosecuted for using their wifi, as he wasn't a paying customer and entitled
to the "included convenience." I suppose it depends on how much attention
you bring to yourself.

Doesn't a licensed Ham have greater leeway - so long as
they do not interfere?
