Duane..Don't be punishing yourself for something you didn't create or condone. Your action for recovery (in N.Y., anyway. ) would be a Small Claims Court matter, which you would plead yourself. Lawyers may not represent clients there. Check with your City Court to find if the money damages you seek are within the limits of a small claim and if you can proceed on your own.  I'm not a lawyer, either, as your other advisor said about himself. We've all been in these frustrating , damnable positions, too. I cannot imagine why your lawyer's preparation and proceedings would be so costly. It's a simple enough set of forms with a minimum of paper and low enough fees . I send this to you at the site because I imagine others aren't aware that there are alternate, inexpensive procedures to seek justice that may make achieving "justice" possible.
