Not to get into a whole legal discussion, but my own experience with trademarks is that more than one company can use the same trademark (ie they can each register a mark) as long as there is no potential for confusion of the public. So another company could not call themselves teletype if they also had something to do with printing (or perhaps more widely printed communications). However, for example, I could open a bakery and name it "microsoft" if I wanted to. AGAIN: I am no lawyer but I have worked with lawyers on registering marks before. This in my layman's understanding
