The problem with passing such legislation isn't with the concept of
'punishment' for distracted driving but the inability to equally enforce
it and correctly enforce it!
As an example, talking with any passengers is 'distracted driving'.
Listening to a hot debate on talk radio and not concentrating on driving
is 'distracted driving', adjusting the radio volume control is
'distracting', concentrating on business issues while behind the wheel and
not on driving issues is 'distracted driving'. Virtually ANY activity
that limits concentration on driving is 'distracted driving'.
So, then, if I have an accident with a driver who is otherwise 'not paying
attention' and I have a ham radio in my vehicle........will I have any
certainty/guarantee that the other driver will get charged with
'distracted driving'? NO.
It is impossible for anyone, let alone a policeman at the scene, to
determine who and to what level 'distracted driving' has contributed to
the incident.
IF the law properly STATES that the 'distracted driving' charge can only
be applied to the driver-at-fault (as determined in a court of law) and
only in accident cases,
I would agree that it would be a fair law. But.............such a law
ALREADY EXISTS in the motor vehicle code under "CARELESS DRIVING".
But it is hardly ever charged or ticketed because it is so hard to defend
it in a court of law, but it is there and can be used against drivers who
exhibit such careless behavior.

My .02: if you're involved in an accident, I don't care if you're
shaving or yakking on a <fill-in-the-blank you don't deserve to have
your distraction ignored by law enforcement just because you hold a
ham license.
