My unofficial explanation on the out-of-band use is that unless someone complains, they get away with it. HF comms is nowhere what it was years back and lots of frequencies are, well, vacant and for the taking.
As for the AME, one sideband and carrier, VOA Greenville did operate one or more of the Gates HF-50C transmitters in this mode, using some home built units based on a Kahn design. IT allowed the AM transmitters to operate in the utility bands and not violate international conventions of the time. This was in the days prior to the satellite networks and program distribution for the overseas VOA transmitter sites.
I think John and Bob have discussed other issues with AME.

I have a couple of questions.....
Why haven't broadcasters gone to single sideband AM? From what I understand,
it loses no fidelity yet requires about half the power for the same signal
level?
How come the religious broadcaster get frequencies outside the normal SW
broadcast spectrum? You hear them all over the dial and some are
broadcasting from the US or other first world countries? If I operated out
of band with multi kilowatts, you can bet I'd be shut down quick!
Sheldon, I'd love to see some info on 4x4 or 4x6 dipole arrays that get
15-25 db gain. Any info on that on the 'net.
Inquiring minds want to know!
