Dave's comments are the very subject that I was making reference to,
organization and how it is governed. I would not want a scenario that he
describes but there are ways to circumvent those problems. The process of
choosing competent, reserved representatives must be rigorous and complete.
As things stand now, we are almost doing the very thing Dave describes.
When we have trouble the FCC relies on us to gather our own evidence and
submit it to them or to work through the OO system. Either way it takes a
very long time and, most often, is frustrating. When Mr. Hollingsworth was
employed he provided the quickest enforcement of the rules that the FCC had
done in years. A person replaced him but I have not witnessed as much
action since he left. Many of you recall the problem that W8VYZ
encountered. He had several determined, adamant complainers against him for
operating AM on 7.290. It took an official investigation and a letter
requiring him to write a response for the problem to be cleared in his
favor. The time frame lasted much longer than it should. What is the
solution to this dilemma?
In the majority of cases requiring Mr. Hollingsworth's involvement were
quickly resolved with nothing more than a letter from his office. Under a
semi-official organization with the power to refer cases to the lawyers
direct, the same effect could result in better behavior of the present hams.
With a semi-official designation it might impress the necessity of proper
operation without direct FCC involvement, therefore saving time and FCC
funds. If you doubt it could be done, the current VE system is an example
of private citizens working with the FCC to provide a good result which
saved the agency a lot of money.
We have been self enforcing for decades but but now some people refuse to
adhere to any rules and that is an increasing problem, about which something
should be done. As things stand now those offenders see no action and
cannot be persuaded to behave. Something should be done and I am open to
ideas.
