And there is another factor.

 

Take the ham that got his license, then got a raise, then decided to “urban
flight” and move out to the suburbs (me 5 years ago).

 

My requirements.

 

Big lot – 1 acre or so

Suitable lot for a medium (50 or 60’) tower – aka no covenants

No HOA – I’m a conservative/libertarian and don’t like neighborhood
busybodies telling me when I have to cut my grass (or whatever).  I’m no
slob, but I WILL fly my flag (US Navy vet) and I might just fix my own car.

New construction or if pre-owned, built in the last 10 or 15 years (I’d
lived in a 1939 house for 15 years and was tired of sub-standard/old code
wiring and wore our plumbing fixtures with un-obtainable replacement parts
(because they don’t make them like that anymore – that’s not always a good
thing, especially if it’s already broken).

 

What I found:

Neighborhoods with cookie cutter houses on big lots (lots of back yard) but
with 15’ between them.  Sorry, if I have to mow an acre I want some “space”
to go with it.

Neighborhoods with 5 acre lots and 3500 SQ FT minimum covenants.

Neighborhoods with covenants

Established neighborhoods with older houses – either 70’s construction (the
oil boom) – and therefore dated fixtures/appliances and wore out plumbing or
worse (older than that) or 90’s construction where they all look the same
(and not a style I like – no front porches)!

Farmland on gravel roads – not good – I ride a Harley.

 

What I did:
found a neighborhood where the developer filed bankruptcy.  No houses, just
vacant lots, but paved roads.  

Argued/persuaded the judge to let me buy one lot and by court order get the
liens cleared by the paving, electrical and plumbing contractors (road,
underground electric and water line – respectively) – and buy the lot for
60¢ on a dollar.

Hire a different contractor (not the bankrupt developer) to build a “custom”
house (farmhouse style with a wrap-around front porch, but new construction
and brick façade)

Have the contractor dig the hole/pour the concrete for the tower base (with
the slab!) – he charged $1000 extra.

 

What I didn’t count on:

Skunks on the back porch

Rattlesnakes in the garage

No cable TV (I don’t watch anything but NFL anyway)

No DSL (means no high speed internet from Cox OR AT&T)

A 35 MILE commute – and Tulsa isn’t that big – to mid-town where my office
is.  Gas would kill me if I worked at the far end of town from where I live.

 

I drive past neighborhoods that I’d LOVE to live in, that are 10 or 12 miles
closer to town, and NICE neighborhoods.  I didn’t buy in them because NONE
of them would let me put up ANY outside antenna.  And since I’m the
“newcomer”, it won’t be grandfathered!

Hi Mac et al.....

 

I understand where you are coming from, but look at it from another
angle....If you have an unlicensed person that lives in an HAO and after
they get the kids out of the house and are looking for a hobby.....they
decide to take up ham radio and they want to have a station, most HOA's just
flatly deny any outside antenna, except of course the 18" satellite dish
(which they HAVE to allow)....wouldn't it be nice for them to be able to
come in front of the HOA and ask for a reasonable external antenna, maybe a
dipole strung in the trees or a ground mounted screwdriver in the back
yard....this bill basically says they just can't deny any form of outside
antenna.   It also doesn't say you can put up a 75' tower just cause you
want to.....it says, they at least have to negotiate with you as to what
will be allowed.....They can require certain levels of good engineering and
some visual restrictions.......but they can't just out and out say no.

 

I know that most of us would never buy in an area like this, but things
change.  You become unable to live alone either physically or financially
and you go to live with your children...and they live where there is an
HOA.....you want to still be active on the air....would you want the HOA to
give you a reasonable accommodation or just tell you sorry buddy, but NO.

 

This bill just gives you the ability to negotiate the same as someone
wanting to make their driveway wider, and yes that would have to be approved
by the HOA.  

 

Not to mention, any subdivision with an HOA is effectively a mini
municipality.....So, why would a mini municipality not be required to abide
by the same rules that all municipalities do?

 

Just think about it....

voluntarily entered into by a buyer.  If you don't want to live by such
restrictions, don't buy the property! 
 
To me, a contract is a contract.  A promise made is like any other promise,
a promise to be kept. 
 
To have government abrogate that contract is purely theft of somebody else's
property and rights. 
 
We already have too much tyrannical government and I strongly disapprove of
