Hi Gary!

Were you at the EC conference Saturday? If so I missed saying hello.

I can also agree with Tom in interpreting 97.405. However look carefully at
97.403 and I think you will find room for a "any frequency anywhere is ok in
emergency" meaning when the "emergency" is defined as I did in my post
(immediate safety of life and protection of property).

Sec. 97.403  Safety of life and protection of property.

    No provision of these rules prevents the use by an amateur station
of any means of radiocommunication at its disposal to provide essential
communication needs in connection with the immediate safety of human
life and immediate protection of property when normal communication
systems are not available.


I interpret that to fit with my proposed intended use of a VHF Marine Radio
in a land station (ARES/RACES EOC shack). Now we are not going to ask how
the fishing is going on a nice day when we want to call in sick :-).

Maybe someone from ARRL is a member of this list and can clarify this?

I agree with N4AOF's comments. Anywhere in the FCC regs where there is
mention of an emergency exception to the general rules it only covers
stations already licensed in that service. This is true for Ham, Marine and
GMRS that I am aware of. If you wish the citations beyond the great job
that N4AOF did, I can provide them.
