Thanks to all who have replied so far. I took Brian's supplied links and found
the specific verbiage in part 95 that prohibits GMRS to use HAM freqs. So in
case anyone else needs this in the future, here it is:
95.655 Frequency capability.
(a) .....
no transmitter will be type accepted for use in the GMRS if it is equipped
with a frequency capability not listed in 95.621, unless such
transmitter is also certificated for use in another radio service for
which the frequency is authorized and for which certification is also
required. (Transmitters with frequency capability for the Amateur
Radio Services, Military Affiliate Radio System and Civil Air Patrol
will not be certificated.)
95.183 Prohibited communications.
(a) A station operator must not communicate:
(13) Messages (except emergency messages) to any station in the Amateur
Radio Service, to any unauthorized station, or to any foreign
station;
Again thanks for all the help! If I cross paths with this guy during the event I
will try to find out about his VX5 usage and if he has been xmit with it he is
illegal.

The short answer is that they all start with 462 MHz.
Amateur frequencies, as you well know are from 420MHz to 450.0 MHz
People operating GMRS can be very helpful in an emergency because you can send
out a non amateur to do something if you have a good base/ repeater so I do not
want to "dis" anyone. I think it is in ARES interest to work with these folks
and educate them and not act as "cops". Since there is no real dedicated GMRS
mobile radio, the radios that are being sold are sold as equivalents to 70CM on
most GMRS-dedicated web sites which consider our kind of licensing procedure
"an artificial barrier" (Not a very helpful approach). The cost of the radios
will restrict the market and probably prevent it from becoming another CB band.
GMRS folks are supposed to know the FCC rules but all they have to do is fill in
a Form 159 and not interfere with commercial users.
I could easily envision some unscrupulous dealer selling that gear to your GMRS
friend and telling him that is what it was and what it did. So he could be
clueless But that doesn't make it right.
