I read through the PRB M&O. It does make mention of Part 97 and "Amateur"
(with a capital A) operators - but does occasionally spell it with a lower
case 'a'. This seems like nothing more than a little inconsistency with the
document writer and NOT a reference other services.. I can't see any
mention of either Citizens Band or Part 95.. leading me - a mere mortal - to
believe that the federal PRB relates only to amateurs.
CB in the US is limited by the regs to contacts of no more than about 155
miles (250km?) and this would eliminate the need for any tall antenna
structures. It's only the lack of enforcement that allows some US CB
operators to make worldwide contacts and boost their power illegally. I
believe that Part 95 CB also has, in the US, limited antenna height in the
regs.
Your zoning folks have gone beyond the intent of the PRB M&O - but there's
nothing legally wrong with that. CB operators should not be prohibited by
zoning from putting up antennas that meet the FCC regs for Part 95 27MHZ
operation. However, local zoning just cannot trump federal regs and allow a
taller CB antenna structure than that allowed by the Part 95 CB regs.
That's what the "P" (pre-emption) in PRB is all about.
